Terms of Use

1. Acceptance of these terms

These Terms of Use are a binding agreement between you and VibeSmith. By accessing or using the website, the Telegram and Discord bots, the mini app, or any related service (together, the “Service”), you agree to these terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a project or organisation, you confirm you are authorised to bind it to these terms.

2. What VibeSmith is

VibeSmith is a non-custodial software tool for the Solana ecosystem. It provides survival scores, trust scans, whale signals, AI-generated raid kits, and a launch wizard. It is informational tooling only. It is not a broker, exchange, wallet custodian, investment adviser, or financial institution, and it does not solicit, recommend, or facilitate any specific transaction.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and legally permitted to use crypto tools where you live. You may not use the Service if you are located in, or are a resident of, a jurisdiction where doing so would be unlawful, or if you are subject to applicable sanctions. You are responsible for complying with the laws that apply to you.

4. Not financial advice

Nothing on VibeSmith is investment, legal, accounting, or tax advice. Vibe scores, survival odds, trust scans, whale signals, and AI output are automated estimates that can be wrong, delayed, or incomplete. They are not a recommendation to buy, sell, or hold any token. Crypto assets are extremely volatile and you can lose everything. Always do your own research and consult a qualified professional before making financial decisions.

5. Non-custodial and your responsibility

VibeSmith never holds your funds or private keys. Any on-chain action (minting a token, trading, joining a raid) is initiated and signed by you through your own wallet. You are solely responsible for the transactions you approve, for safeguarding your wallet and seed phrase, and for independently verifying any contract address before you act. We cannot reverse, cancel, or recover on-chain transactions.

6. Your account and wallet connection

Some features require you to connect a Solana wallet and sign a message to prove ownership. That signature creates a short-lived session. You are responsible for activity that occurs through your connected wallet or linked bot account. We may rate-limit, throttle, or refuse requests to protect the Service, and anti-abuse usage limits are enforced server-side.

7. Pricing

VibeSmith is currently provided free of charge. There are no paid tiers, subscriptions, or in-app payments. If paid features are ever introduced, prices, billing terms, and any on-chain payment flow will be disclosed at the point of purchase before you are charged anything.

8. Acceptable use

You agree not to misuse the Service. Prohibited activity includes: scraping or harvesting data at scale, circumventing usage limits, rate limits, or access controls, uploading unlawful, infringing, or malicious content, impersonating others, interfering with or attacking the Service or its infrastructure, and using VibeSmith to promote fraud, market manipulation, or any illegal scheme. We may remove content and suspend access for violations.

9. User content and submissions

You are responsible for the content you submit, including token metadata you forge, raid copy you generate or publish, and reports you file. You confirm you have the rights to that content and that it does not violate any law or third-party right. You grant VibeSmith a non-exclusive, worldwide, royalty-free licence to host, display, and process your submissions solely to operate and improve the Service. AI-generated raid kits are provided for your use; you are responsible for what you publish.

10. Intellectual property

The VibeSmith name, logo, interface, copy, and original software are owned by VibeSmith and its contributors and are protected by intellectual property law. These terms grant you a limited, revocable, non-transferable licence to use the Service for its intended purpose. You may not copy, resell, reverse engineer, or create derivative works from the Service except as permitted by law or with our written consent.

11. Third-party services

VibeSmith relies on third parties including the Solana network, RPC and data providers, Jupiter, Helius, Pinata and IPFS, Telegram, Discord, and hosting, error, and infrastructure providers. We do not control them and are not responsible for their availability, accuracy, or terms. Your use of those services may be governed by their own terms and privacy policies.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that scores, signals, or data will be accurate, timely, uninterrupted, or error-free. You use the Service at your own risk.

13. Limitation of liability

To the maximum extent permitted by law, VibeSmith and its contributors will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any trading losses, rug pulls, missed alerts, downtime, lost profits, or lost data arising from or related to your use of the Service. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the prior three months or USD 100.

14. Indemnification

You agree to indemnify and hold harmless VibeSmith and its contributors from any claim, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your content, or your breach of these terms or of any law or third-party right.

15. Suspension and termination

We may suspend or terminate your access at any time if you breach these terms, create risk for other users or the Service, or where required by law. You may stop using the Service at any time by disconnecting your wallet and discontinuing use. Sections that by their nature should survive termination (including disclaimers, liability limits, and indemnities) will continue to apply.

16. Governing law and disputes

These terms are governed by the laws applicable at VibeSmith's principal place of operation, without regard to conflict-of-law rules. You agree to first attempt to resolve any dispute with us informally by contacting us. Any dispute that cannot be resolved informally will be handled by the competent courts of that jurisdiction, except where mandatory local law gives you the right to bring a claim elsewhere.

17. Changes to these terms

We may update these terms as the product evolves. When we make material changes we will update the date above. Continued use of the Service after an update means you accept the revised terms.
